Welcome to TalentMark Placement Agency. These terms and conditions govern the relationship between TalentMark Placement Agency, hereinafter referred to as "the Agency," and any entity or individual utilizing our placement services, hereinafter referred to as "the Client."
2. Candidate Screening and Verification:
The Agency is committed to thoroughly screening and verifying candidate details. However, it is the responsibility of the Client to independently investigate and validate the information provided by candidates before making any hiring decisions. The Agency shall not be held liable for any inaccuracies in the candidate's information.
3. Fraudulent Activities:
In the event of a candidate engaged through our services being found involved in any fraudulent activities, the Agency will cooperate with the Client and relevant authorities in the investigation. The Agency, however, shall not be held responsible for the actions of the candidate.
4. Theft or Misconduct:
The Agency condemns any form of theft or misconduct by candidates. In the unfortunate event that a candidate is found involved in such activities, the Client agrees to handle the matter independently. The Agency is not liable for any loss or damage caused by the candidate's actions.
5. Candidate Departure:
Candidates have the right to resign from their positions at any time. While the Agency will make reasonable efforts to inform the Client in advance of a candidate's resignation, the decision to resign is at the sole discretion of the candidate. The Agency shall not be held responsible for any inconvenience caused by the candidate's departure.
6. Dispute Resolution:
In the event of any dispute arising between the Client and the candidate, the Agency will act as a mediator to facilitate a resolution. However, the Agency is not a party to the employment relationship and shall not be held responsible for the outcome of any disputes.
7. Indemnity:
The Client agrees to indemnify and hold the Agency, its employees, and representatives harmless from any claims, demands, or damages arising out of or in connection with the hiring of candidates through our services.
8. Amendments to Terms and Conditions:
The Agency reserves the right to amend these terms and conditions at any time. The Client will be notified of any changes, and continued use of our services implies acceptance of the revised terms.
9. Governing Law:
These terms and conditions shall be governed by and construed in accordance with the laws of [Your Jurisdiction]. Any disputes arising from these terms and conditions shall be subject to the exclusive jurisdiction of the courts in [Your Jurisdiction].
